      Atlanta Municipal Court vs. Fulton County State Court

      Once you are arrested for a DUI in Atlanta, you enter the complex and multi-layered system that the State of Georgia employs. For drivers, a major confusion is determining which court has jurisdiction over the case. The majority of DUI arrests by the Atlanta Police Department or by the Georgia State Patrol within city limits start with an arrest in the Atlanta Municipal Court. This is rarely the end of a heavy DUI case, though. It is essential to know how and why a case is transferred from municipal court to state court, and how this can be avoided, in order to develop a defense strategy and preserve your right to drive.

      Atlanta Municipal Court is a very fast moving court. Usually an arraignment is held within 1-2 business days after the arrest. This is so many cases are recorded, that the court is set up to move through misdemeanors quickly. The court doesn’t have the jurisdiction to conduct jury trials, but judges in municipal court can proceed with a bench trial, in which a single judge decides if you are guilty or innocent. The Georgia Constitution guarantees each person accused of a criminal misdemeanor the right to a trial by a jury. If you elect to exercise your right, defend your DUI in a trial before a jury, your case will not be able to remain in Atlanta Municipal Court. Must be bound over or transferred to Fulton County State Court.

      If you have a skilled DUI attorney, you may want to choose a jury trial and consent to binding over to Fulton County. Atlanta Municipal Court has a fast moving calendar and it’s difficult to get the complex evidence, review the breathalyzer calibration logs, and conduct full questioning of the arresting officers. It is as if the clock had been reset when the case is transferred to state court. It provides valuable additional time for in-depth examination and the filing of formal discovery motions and the preparation of a strong defense.

      Moreover, this transfer offers what many defense attorneys call “two bites at the apple. You and your lawyer can try to plea bargain with the city prosecutor in Atlanta Municipal Court for a reduction or dismissal. In the event those prosecutors are not willing to yield, you can bind the case over to Fulton County State Court. After the case is transferred, the legal staff assigned to your case will also change. The case goes from the hands of the municipal prosecutors to the Fulton County Solicitor General’s Office. State court prosecutors may face varying pressures in their cases and may consider evidence differently, creating new possibilities for plea negotiations or reductions.

      But there are some issues that come with binding a case over, especially in terms of time. After being transferred to Fulton County State Court, a case is in a virtual holding pattern until the state court prosecutor formally charges the case. If you are arrested for a misdemeanor in Georgia, the state has a maximum of two years from the date of the arrest to file an accusation against the case, which could put your trial months or years in the future. This long wait needs a measured and patient approach to the law. The memories of officers fade over time and police witnesses move away or may change their careers, sometimes to the detriment of the prosecuting side. However, with this long delay, you will need a steady hand to ensure that your bond conditions are never lost or confused and your life isn’t completely on hold.

      One, which is frequently forgotten, aspect of this jurisdictional change is the civil administrative suspension of the driver’s license. In Georgia, a DUI arrest then initiates two completely different legal processes: the criminal charge, and the civil administrative driver license action. You may appeal or request a permit for an ignition interlock within 30 days after being arrested to avoid an automatic suspension of your driver license. The 30 days administrative deadline is not stopped, restarted, or changed by transferring your criminal case from Atlanta Municipal Court to Fulton County State Court. The administrative aspect will not be ignored and can be the cause of losing the license without the case ever resolving in Fulton County State Court.

      It’s important for you to understand the Georgia criminal procedure and judicial tradition if you are going to jump between these two courts. Filming in the state court is a very strong tactic because it will ensure that you retain your constitutional rights, and you will be able to force the prosecution to adhere to very stringent evidentiary standards. When it comes to the unique roles, timelines and staffing of both the Atlanta Municipal Court and the Fulton County State Court, the difference between a rushed conviction and a successfully defended case can lie in the knowledge of the former.
